The Illinois Department of Transportation (Department) is authorized by the Illinois Vehicle Code (Code) [625 ILCS 5/Ch. 15] to issue special permits. These special permits allow the operation of vehicles or loads that exceed the legal maximum dimensions and weights. The permits are valid only for those highways under Department jurisdiction. This Part supersedes all policies previously established and published by the Department pertaining to oversize and overweight permit movements.
Troopers Lodge #41, Fraternal Order of Police -vs-State of Illinois, Department of Central Management Services (State Police): On June 20, 2013, Troopers Lodge #41, Fraternal Order of Police (Charging Party) filed an unfair labor practice charge with the State Panel of the Illinois Labor Relations Board (Board), in Case No. S-CA-13-148, alleging that the State of Illinois, Department of Central Management Services (State Police) (Employer or Respondent) violated Section 10(a) of the Illinois Public Labor Relations Act (Act), 5 ILCS 315 (2012) as amended. After an investigation pursuant to Section 11 of the Act, on December 31, 2013, I ordered this matter deferred to arbitration, and that within 15 days after the completion of the arbitration process Charging Party may request that the Board reopen the case for the purpose of resolving any substantial issues.
James Young -vs- Village of University Park: On December 24, 2013, James W. Young (Charging Party) filed an unfair labor practice charge with the State Panel of the Illinois Labor Relations Board (Board) in Case No. S-CA-14-107, alleging that the Village of University Park (Respondent) violated Section JO(a) of the Illinois Public Labor Relations Act (Act), 5 ILCS 315 (2012), as amended. On Jaimary 15, 2014, Charging Party amended his charge. On April 24, 2014, I issued an Order Holding Case in Abeyance pending the resolution of a pending grievance. 1 After an investigation conducted in accordance with Section 11 of the Act, I detennined that a portion of this charge fails to raise an issue of law or fact sufficient to warrant a hearing and hereby issue this partial dismissal for the reasons stated below.
