On March 31, 2017, the State of Illinois, Department of Central Management Services (Employer) filed a unit clarification petition seeking to exclude four positions in the Administrative Assistant I, Administrative II, and Executive I classifications from bargaining units represented by the American Federation of State County and Municipal Employees, Council 31 (AFSCME). The Employer withdrew its petition as to one Administrative II position and AFSCME withdrew its objection to the exclusion of the Executive I position as confidential, leaving only two positions at issue in the instant petitionone Administrative I (AAI) position at the Illinois Liquor Control Commission (LCC) and one Administrative II position at the Department of Financial and Professional Regulation (DFPR).1 The Employer asserts the two positions remaining at issue should be excluded because they fall within the confidential employee exclusion set forth in Section 3(c) of the Act.
