Tyron McCullough -vs- Harvey Park District: On July 16, 2014, Administrative Law Judge (ALJ) Deena Sanceda issued a Recommended Decision and Order (RDO), recommending that the Illinois Labor Relations Board, State Panel, order Respondent Harvey Park District to comply with orders previously issued by the Board in consolidated Case Nos.S-CA-12-197-C, S-CA-12-201-C and S-CA-12-211-C, modified only to provide for the accrual of additional back pay and interest accumulating since isuance of those orders. Respondent filed timely exceptions to the ALJ's RDO pursuant to Section 1200.135 of the Board's rules and regulations, 80 Ill. Admin. Code (sec) 1200.135, and Charging Party, Tyron McCullough, filed a response. After reviewing the exceptions, the response, and the record, we accept the ALJ's recommendation for the reasons articulated in the RDO, and order Respondent to comply with the Compliance Officer's order as modified to allow for additional back pay and interest accruing since the date that order was issued.

International Brotherhood of Teamsters, Local 700 -vs- Illinois State Toll Highway Authority: On January 23, 2015, Administrative Law Judge Deena Sanceda (ALJ) issued a Recommended Decision and Order in the above-captioned case, recommending the Illinois Labor Relations Board, State Panel, find that employees in the title of Sign Shop Manager, Sign Shop Supervisor, Road Electric Manager, Central Garage Manager, and Central Garage Supervisor employed by the Illinois State Toll Highway Authority were not supervisors within the meaning of Section 3(r) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2014), as amended, (Act), and that a secret ballot election should be conducted among those employees to determine if they wished to be represented by the International Brotherhood of Teamsters, Local 700, or have No Representation. The ALJ also recommended that the Board find that employees in the titles of Maintenance Section Managers and Maintenance Section Supervisors were supervisors within the meaning of the Act and should be excluded from the petitioned-for unit.

County of Will and Will County State;s Attorney -vs- American Federation of State, County and Municipal Employees Council 31: On April 11, 2014, Administrative Law Judge Anna Hamburg-Gal issued a Recommended Decision and Order in which she determined that the unit clarification petition filed by the County of Will and the Will County State's Attorney (Petitioners) was appropriate and should be granted. Applying Office of the Cook Cnty. State's Attorney v. Ill. Local Labor Rel. Bd., 166 Ill. 2d 296 (1995), she determined that the Will County Assistant State's Attorneys employed by the Petitioners and certified into a collective bargaining unit in our prior Case No. S-VR-93-001, were not public employees within the meaning of Section 3(n) of the Public Labor Relations Act, 5 ILCS 315/3(n)(2012), and therefore should be excluded from any existing bargaining unit.

Lori Crafton -vs- Department of Central Management Services (Corections): On March 17, 2014, Executive Director Melissa Mlynski issued a dismissal of an unfair labor practice charge filed by Charging Party, Lori Crafton, against Respondent, the State of Illinois, Department of Central Management Services (Department of Correction). The charge, filed on December 2, 2013, alleged that Respondent violated Section 10(a) of the Illinois Public Labor Relations Act, 5 ILCS 315/10(a)(2012)(Act), by a course of conduct beginning with issuance of a three-day suspension of Charging Party in September 2012 and ending about July 12, 2013, with the denial of Charging Party's grievance regarding that suspension filed pursuant to Respondent's personnel rules.
