American Federation of State, County and Municipal Employees, Council 31 and International Brotherhood of Teamsters, Local 700 -vs- City of Evanston: On October 12, 2012, Administrative Law Judge (ALJ) Martin Kehoe issued a recommended decision and order (RDO) in the above-captioned consolidated cases finding that the Illinois Labor Relations Board, State Panel, should dismiss an unfair labor practice complaint in Case No. S-CA-11-057 alleging a violation of Section 10(a)(4) and (1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), based on charges of a failure to bargain filed by the American Federation of State, County and Municipal Employees, Council 31 (AFSCME) against the City of Evanston (Employer). The ALJ further found with respect to competing unit clarification petitions filed by AFSCME in Case No. S-UC-11-015 and by the International Brotherhood of Teamsters Local 700 in Case No. S-UC-11-019, that the Board should conduct a secret ballot election to determine employee preference for representation.

On January 5, 2012, Executive Director John F. Brosnan dismissed the unfair labor practice charge filed by the International Brotherhood of Teamsters, Local 700 (Charging Party) in the above-captioned case. The Charging Party alleged that the State of Illinois, Department of Central Management Services (Respondent) violated Section 10(a)(1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), as amended (Act), by failing to provide bargaining unit member Master Sergeant Beliveau with union representation at an interview as he had requested. The Executive Director dismissed the charge, finding Beliveau had no right to the presence of a union representative under NLRB v. Weingarten 420 U.S. 251 (1975), and its progeny because Beliveau lacked a reasonable expectation that he might be disiplined.

On January 23, 2012, Administrative Law Judge (ALJ) Martin Kehoe issued a Recommended Decision and Order (RDO) in the above-captioned case, finding that three individuals in the title of Public Service Administrator, Option 8L, employed by the State of Illinois, Department of Central Management Services (Department of Healthcare and Family Services)(Employer) were neither supervisors nor managerial employees as defined by the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), as amended (Act), and ordering that these three individuals' positions be included in the existing RC-10 bargaining unit currently represented by the American Federation of State, County and Municipal Employees, Council 31 (Petitioner).

Antwaun Parnell -vs- County of Kankakee and Sheriff of Kankakee County: On December 13, 2013, Administrative Law Judge Philip M. Kazanjian, on behalf of the Illinois Labor Relations Board, issued a Recommended Decision and Order in the above-captioned matter. No party filed exceptions to the Administrative Law Judge's Recommendation during the time allotted, and at its February 11, 2014 public meeting, the Board, having reviewed the matter, declined to take it up on its own motion.

Shannon Watkins -vs- Village of Dolton: On February 22, 2011, Executive Director, John F. Brosnan, dismissed the unfair labor practice charge filed by Shannon Watkins (Charging Party) in the above-captioned case. The Charging Party alleged that the Village of Dolton (Respondent) engaged in unfair labor practices within the meaning of Section 10(a)(2) and (1) of the Illinois Public Labor Relations Act, 5 ILCS 315/10(a)(1), (2) (2010), by failing to inform her exclusive bargaining representative, the Fraternal Order of Police Labor Council, that it had removed her from the bargaining unit (by promoting her from Records Clerk to the allegedly confidential position of Confidential Executive Secretary to the Police chief), and by subsequently laying her off (in connection with dismissal of the police chief).

This report covers our financial audit for the year ended June 30, 2011 and compliance examination for the two years ended June 30, 2011 of the Department of Healthcare and Family Services. At June 30, 2011, the Health Insurance Reserve Fund was owed $1,275,439,000 from other State funds and component units to fund current costs for State employees health insurance. As of June 30, 2011, the Other Postemployment Benefit Plan has a financial liability of $5,716,357,000. The Actuarys Report estimated the liability for Other Postemployment Benefits as of June 30, 2011. The Unfunded Actuarial Accrued Liability was estimated to be $33,295,354,000. Current financial reporting standards do not require the entire actuarial liability amount be reported on the face of the financial statements; however, the information is disclosed in Note 9 of the financial statements.

Section 6.1 of the Illinois Public Labor Relations Act, 5 ILCS 315 (2012), allows the Governor to designate certain employment positions with the State of Illinois as excluded from collective bargaining rights which might otherwise be available under Section 6 of the Act. This case involves such designations made on the Governors behalf by the Illinois Department of Central Management Services (CMS) in a petition filed in Case No. S-DE-14-158. On January 31, 2014, Administrative Law Judge (ALJ) Anna Hamburg-Gal issued a Recommended Decision and Order (RDO), finding the designations comport with the requirements of Section 6.1. We agree with her assessment.
