On November 13, 2013, the County of Will (Petitioner) filed a Petition for Strike Investigation with the State Panel of the Illinois Labor Relations Board (Board), pursuant to Section 18 of the Illinois Public Labor Relations Act, 5 ILCS 315 (2012), as amended (Act), and Section 1230.190 of the Board's Rules and Regulations, 80 Ill. Admin. Code Section 1200 through 1240 (Rules). The Petitioner claims that a strike threatened by the American Federation of State, County and Municipal Employees, Council 31, (Union), the exclusive representative of a bargaining unit composed of certain of the Petitioner's employees, constitutes a clear and present danger to the health and safety of the public.

On July 25, 2013, Executive Director Melissa Mlynski dismissed the unfair labor practice charge filed by the Amalgamated Transit Union, Local 1028, (Charging Party) in the above-referenced case. The Charging Party alleged that Pace Suburban Bus (Respondent) engaged in an unfair labor practice within the meaning of Section 10(a) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2012), when it required its supervisors to advise employees that they could no longer use leave granted under the Family and Medical Leave Act provision in the parties' collective bargaining agreement as an excusable absence.

Department of Central Management Services(Department of Insurance) -vs- American Federation of State, County and Municipal Employees, Mary Petersen and Michael Teer: Section 6.1 of the Illinois Public Labor Relations Act, 5 ILCS 315 (2012), allows the Governor to designate certain employment positions with the State of Illinois as excluded from collective bargaining rights which might otherwise be available under Section 6 of the Act. This case involves such designations made on the Governors behalf by the Illinois Department of Central Management Services (CMS). On December 18, 2013, Administrative Law Judge (ALJ) Elaine L. Tarver issued a Recommended Decision and Order (RDO) in Case No. S-DE-14-137, finding the designations comport with the requirements of Section 6.1.

American Federation of State, County and Municipal Employees, Council 31 and International Brotherhood of Teamsters, Local 700 -vs- City of Evanston: On October 12, 2012, Administrative Law Judge (ALJ) Martin Kehoe issued a recommended decision and order (RDO) in the above-captioned consolidated cases finding that the Illinois Labor Relations Board, State Panel, should dismiss an unfair labor practice complaint in Case No. S-CA-11-057 alleging a violation of Section 10(a)(4) and (1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), based on charges of a failure to bargain filed by the American Federation of State, County and Municipal Employees, Council 31 (AFSCME) against the City of Evanston (Employer). The ALJ further found with respect to competing unit clarification petitions filed by AFSCME in Case No. S-UC-11-015 and by the International Brotherhood of Teamsters Local 700 in Case No. S-UC-11-019, that the Board should conduct a secret ballot election to determine employee preference for representation.

On January 5, 2012, Executive Director John F. Brosnan dismissed the unfair labor practice charge filed by the International Brotherhood of Teamsters, Local 700 (Charging Party) in the above-captioned case. The Charging Party alleged that the State of Illinois, Department of Central Management Services (Respondent) violated Section 10(a)(1) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), as amended (Act), by failing to provide bargaining unit member Master Sergeant Beliveau with union representation at an interview as he had requested. The Executive Director dismissed the charge, finding Beliveau had no right to the presence of a union representative under NLRB v. Weingarten 420 U.S. 251 (1975), and its progeny because Beliveau lacked a reasonable expectation that he might be disiplined.

On January 23, 2012, Administrative Law Judge (ALJ) Martin Kehoe issued a Recommended Decision and Order (RDO) in the above-captioned case, finding that three individuals in the title of Public Service Administrator, Option 8L, employed by the State of Illinois, Department of Central Management Services (Department of Healthcare and Family Services)(Employer) were neither supervisors nor managerial employees as defined by the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), as amended (Act), and ordering that these three individuals' positions be included in the existing RC-10 bargaining unit currently represented by the American Federation of State, County and Municipal Employees, Council 31 (Petitioner).

Brosnan, dismissed the unfair labor practice charge filed by Shannon Watkins (Charging Party) in the above-captioned case. The Charging Party alleged that the Village of Dolton (Respondent) engaged in unfair labor practices within the meaning of Section 10(a)(2) and (1) of the Illinois Public Labor Relations Act, 5 ILCS 315/10(a)(1), (2) (2010), by failing to inform her exclusive bargaining representative, the Fraternal Order of Police Labor Council, that it had removed her from the bargaining unit (by promoting her from Records Clerk to the allegedly confidential position of Confidential Executive Secretary to the Police chief), and by subsequently laying her off (in connection with dismissal of the police chief).

Dutchman Creek TMDL Report

Water quality data are gathered by the IEPA, the US Geological Survey, and the USEPA. Illinois is required to identify water bodies that do not meet water quality standards and to determine the Total Maximum Daily Load for pollutants causing the impairment.
