Telecommunications Tax Rate Changes Effective January 1, 2013

Effective January 1, 2013, the following municipalities are imposing a simplified municipal telecommunications tax or changing their tax rate. The combined rate is the state Telecommunications Excise Tax rate of 7.00 percent (.07) plus the local Simplified Municipal Telecommunications Tax rate of up to a maximum rate of 6.00 percent (.06) outside Chicago.

Justice Karmeier delivered the judgment of the court, with opinion. Chief Justice Kilbride and Justices Freeman, Thomas, Garman, Burke, and Theis concurred in the judgment and opinion. The issue presented in this case is whether, under section 543 of the Unified Code of Corrections (Code) (730 ILCS 5/543 (West 2008)), a trial court has the authority to order a defendant to submit a sample of his deoxyribonucleic acid (DNA) for forensic analysis and indexing and to pay a $200 DNA analysis fee where that defendant has already submitted a DNA sample pursuant to a prior conviction and has paid a corresponding analysis fee.

Bath Landfill

This 17-acre landfill southwest of Decatur on the south bank of the Sangamon River was permitted in 1974 as a demolition debris landfill. It originated as an open dump in 1918. The site had a history of not complying with the state landfill rules in the 1980s. The landfill also exceeded its permitted waste disposal limits, by the time that operations stopped in 1991. The owner failed to comply with an August 1994 court order requiring proper cover to be installed and maintained. Visible leachate seeps (leachate is water that has traveled through the landfill and contacts waste material) and exposed refuse were observed along the bank of the Sangamon River.
